This legal notice is governed by Monegasque law. The courts of the Principality of Monaco shall have jurisdiction in the event of a dispute.
This Authorization defines the conditions under which the Y.C.M. authorizes the Beneficiary to take and/or reproduce the Photographs, as well as the obligations and responsibilities of each of the Parties. The Authorization consists of the present General Conditions and the description of the Authorization on the first page. In the event of contradiction between the General Conditions and any other document, the General Conditions shall prevail.
The Beneficiary shall strictly refrain from photographing / filming and from disturbing customers or walkers in the areas where it will operate. The Beneficiary must also refrain from photographing / filming in the areas reserved for members during opening hours. The beneficiary must leave the premises in the condition in which he/she found them, and must clear them of any equipment belonging to him/her as soon as the shooting is over.
All installations for filming are subject to prior approval by the Yacht Club de Monaco, and the assembly, dismantling and transport of all equipment are the responsibility of the Beneficiary.
The Beneficiary shall comply with all applicable laws and regulations. The Beneficiary shall comply with all applicable health and safety laws and regulations.
The Beneficiary shall ensure that no moral, material or political prejudice is caused, either directly or indirectly, to the Y.C.M. or to the Principality of Monaco, or to the latter’s international relations, by the photographs taken.
Any use of a “drone” to take aerial photographs must obtain the prior written authorization of the Direction Générale de l’Aviation Civile in Monaco and the Monegasque Department of the Interior, the obtaining of the said authorizations being a condition precedent to the consent given by the Yacht Club de Monaco to the present contract.
The locations chosen for the photo shoots are the private property of the Yacht Club de Monaco. All requests to take photographs in the Principality must be authorized by the Monegasque authorities (information on the website: http://service-public-entreprises.gouv.mc/En-cours-d-activite/Autorisations-ponctuelles/Communications-et-media/Demander-une-autorisation-de-prises-de-vues-en-Principaute-de-Monaco).
Authorization is given for the destinations, media and duration mentioned. It is understood that the Beneficiary expressly forbids any other use, by itself or by any third party, commercial or otherwise, on any medium whatsoever and in any form whatsoever, as well as any use that might damage the image of the Yacht Club de Monaco. It is specified that the right to the image of Y.C.M. personnel is expressly reserved and that the Beneficiary must obtain the consent of the said personnel if he wishes to photograph them.
The commercial sign, logos, symbols, brands or any other intellectual property rights, in particular the expressions “Yacht Club de Monaco”, “La Belle Classe”, “L’Art de Vivre la Mer” “Monaco, capital of Yachting”, held by the Y.C.M. and/or its affiliated brands are the exclusive property of the Y.C.M..
The Y.C.M. may entrust the Beneficiary with written or oral information and documents. The Beneficiary is prohibited from communicating to anyone, directly or indirectly, all or part of the documents and oral or written information communicated to him by the Y.C.M. or of which he may have become aware in connection with the present contract. The Beneficiary acknowledges that any disclosure would seriously harm the interests of the Yacht Club de Monaco and undertakes to ensure that all his employees involved in the filming comply with the present article.
